Its authority is derived from the 1999 Constitution of the Federal Republic of Nigeria (as amended), which provides the legal foundation for the existence, powers, and jurisdiction of every state High Court in Nigeria.<\/p><p data-start=\"776\" data-end=\"1040\">Through the Constitution, the High Court is recognized as the apex trial court in Kogi State, vested with the power to interpret laws, enforce rights, and oversee the administration of justice across its 23 judicial divisions and numerous subordinate courts.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-c710d51 e-con-full e-flex wpr-particle-no wpr-jarallax-no wpr-parallax-no wpr-sticky-section-no e-con e-child\" data-id=\"c710d51\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-b24b415 elementor-widget elementor-widget-heading\" data-id=\"b24b415\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Section 270(1): Establishment of the High Court<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-04de082 e-con-full e-flex wpr-particle-no wpr-jarallax-no wpr-parallax-no wpr-sticky-section-no e-con e-child\" data-id=\"04de082\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t<div class=\"elementor-element elementor-element-1ca7ce0 e-con-full e-flex wpr-particle-no wpr-jarallax-no wpr-parallax-no wpr-sticky-section-no e-con e-child\" data-id=\"1ca7ce0\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-ce99877 elementor-widget elementor-widget-text-editor\" data-id=\"ce99877\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p data-start=\"1104\" data-end=\"1223\">The Constitution, under Section 270(1), makes it mandatory for every state in Nigeria to have its own High Court:<\/p><blockquote data-start=\"1224\" data-end=\"1293\"><p data-start=\"1226\" data-end=\"1293\"><em data-start=\"1226\" data-end=\"1291\">\u201cThere shall be a High Court for each State of the Federation.\u201d<\/em><\/p><\/blockquote><p data-start=\"1295\" data-end=\"1683\">This provision gave birth to the Kogi State High Court upon the creation of the state in 1991. From its initial four divisions\u2014Lokoja, Ankpa, Idah, and Okene\u2014the Court has expanded into a robust judicial system with 23 divisions, over 200 subordinate courts, and 9 zonal inspectorates, ensuring that justice is not limited to the state capital but reaches every region of the state.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-bdba8f7 e-con-full e-flex wpr-particle-no wpr-jarallax-no wpr-parallax-no wpr-sticky-section-no e-con e-child\" data-id=\"bdba8f7\" data-element_type=\"container\" data-end=\"2007\">The jurisdiction of the High Court is provided in Section 272(1) of the Constitution:<\/p><blockquote data-start=\"2008\" data-end=\"2335\"><p data-start=\"2010\" data-end=\"2335\"><em data-start=\"2010\" data-end=\"2333\">\u201cSubject to the provisions of Section 251 and other provisions of this Constitution, the High Court of a State shall have jurisdiction to hear and determine any civil or criminal proceedings in which the existence or extent of a legal right, power, duty, liability, privilege, interest, obligation, or claim is in issue\u2026\u201d<\/em><\/p><\/blockquote><p data-start=\"2337\" data-end=\"2671\">This gives the High Court broad authority to preside over both civil and criminal cases, including disputes about rights, obligations, contracts, property, and serious criminal offenses. It ensures that the Court functions as the apex trial court in Kogi State, handling matters of significant importance and complexity.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-32d062d e-flex e-con-boxed wpr-particle-no wpr-jarallax-no wpr-parallax-no wpr-sticky-section-no e-con e-parent\" data-id=\"32d062d\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t<div class=\"elementor-element elementor-element-fcb3dfe e-con-full e-flex wpr-particle-no wpr-jarallax-no wpr-parallax-no wpr-sticky-section-no e-con e-child\" Constitutional Provisions Relevant to the High Court<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-ef12978 e-con-full e-flex wpr-particle-no wpr-jarallax-no wpr-parallax-no wpr-sticky-section-no e-con e-child\" data-id=\"ef12978\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-8acf79d elementor-widget elementor-widget-text-editor\" data-id=\"8acf79d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p data-start=\"2923\" data-end=\"3040\">In addition to Sections 270 and 272, several other constitutional provisions guide the operation of the High Court:<\/p><ul data-start=\"3042\" data-end=\"3674\"><li data-start=\"3042\" data-end=\"3158\"><p data-start=\"3044\" data-end=\"3158\">Judicial Independence (Section 36 &amp; 6): Guarantees the independence of courts and the right to fair hearing.<\/p><\/li><li data-start=\"3159\" data-end=\"3359\"><p data-start=\"3161\" data-end=\"3359\">Appointment of Judges (Section 271): Provides for the appointment of the Chief Judge and other judges by the Governor of the State on the recommendation of the National Judicial Council (NJC).<\/p><\/li><li data-start=\"3360\" data-end=\"3494\"><p data-start=\"3362\" data-end=\"3494\">Tenure and Retirement (Section 291): Judges hold office until the mandatory retirement age, ensuring stability and continuity.<\/p><\/li><li data-start=\"3495\" data-end=\"3674\"><p data-start=\"3497\" data-end=\"3674\">Supervisory Role: The Constitution empowers the High Court to supervise the work of lower courts, ensuring accountability and consistency in the administration of justice.<\/p><\/li><\/ul><p data-start=\"3676\" data-end=\"3833\">Together, these provisions form the legal backbone of the High Court, ensuring it remains an independent, impartial, and effective guardian of justice.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-b944991 e-con-full e-flex wpr-particle-no wpr-jarallax-no
